Abel McCallister Designs hired my company to staff a bar at a local food festival for a three-day weekend. They gave me a deposit of 40%, and I was to front materials. Our contract stated that the balance and cost of materials were to be paid at the conclusion of the event. The event had a few problems, all of which were generated from AMD’s poor organization and lack of planning. My employees and I worked in the extremely uncomfortable environment (over ninety degrees, no shade, confining and poorly-designed bar, and actual customers were 10X the projected numbers they had provided), with smiles on our faces. We really pulled off a great service considering the challenges. | Several days later (after payment was due), Raymond McCallister contacted me to let me know that AMD would only be paying 90% of the bill, due to complications and problems with service delivery that were ostensibly my fault. I had been warned previously (by his own employees, no less) that Raymond was known for shady behavior, and I strongly suspected that he would claim immaterial grievances in an effort to avoid paying his bill. I grudgingly accepted his offer on the condition that it would be paid immediately. | That’s when AMD went silent. No payment, no responses to my multiple emails and text messages. For weeks they simply did not pay me and would not communicate with me in any manner. Finally, a pornography attorney in LA contacted me and threatened to sue me unless I signed an absurd gag order that left my company substantially exposed in perpetuity to the whims of Raymond and his PornLaw buddy. I said no way. I am suing them in King County court and intend to take this matter as far as needed to recover what is contractually owed to me.
